F1 stamping

Hi,

I have entered the US on H4 and converted to F1 after being admitted to a university .I will be finishing my graduation by December 2003.

For the first time after receiving F1 approval notice I am planning a trip to India. While coming back I need to get F1 stamping on my passport. My questions are:

1) Can I use drop-box facility instead of attending for an interview at the consulate because I already have F1 approval notice?
2) What documents do I need to submit them?
3) In case if they reject F1 stamping on my passport can I still come here on H4 visa?

Thank you

1) and 2) It might depend on the consulate. Check ttsvisas.com or visa-services.com

3) If the consulate does not cancel the H4 visa stamp on your passport, and it is still unexpired, then you can enter on H4 visa. But you cannot be an RA/TA if you do so.

I don't think there is drop box facility for F-1. I recently heard that they have removed this faclity for other visas also (not confirmed, just heard from someone). Only old and under age kids are allowed for drop box.

If I were you then I would postpone the visit till you could convert your F1 to H1/H4. My wife's case is exactly the same as yours. My attorney has adviced not to travel to India on F-1, because of high probability of rejection. Because when you apply for F-1 visa at the embassy, their first and foremost question is "Will you return to India after completing studies" You can't say no because your spouse is already here on H1, so it will be tough for you to prove your intent to return to India after graduation.

I am not aware of the fact which Raj1994 has mentioned that you could return on H4, because my understaning says that once you F1 was approved then your H-4 automatically gets cancelled because now F-1 is you most recent visa status and thats what is there in BCIS records.

I Agree with hrtomd. My wife got F2->F1 and we are not thinking of her visiting India for a while.

Apart from rejection, one more thing we are afraid of is that she might have to produce all those proofs of being financially able to get through her course of studies. Does anyone have any info about that? Do we need to prove once again when we go for F1 visa at american consulate that we are financially capable?

Once the change of status is approved,
You are no longer on H4.

True, but then you can leave the country while on F1, and reenter on another status such as H4 if you have the necessary visa and supporting documents. The term status is only meaningful when the person in inside the US. Once you leave the country, then the notion of status does not exist. So if an F1 leaves the US, his status is gone. Now the next time he enters the US, his status will be determined afresh by the reason and supporting documents he provides the inspector at the POE. The previous change of status from H4 to F1 is irrelevant here.
