i came to america 7months ago with an f1 visa... but person who was supposed 2 pay my school expenses and i got into a fight and we dont talk anymore...so i havent even showed up in that school which has issued my I20 form... in the meantime i ve been living with my family friends and they support me and plus thank god i had a job last summer in my home country...one day in november i met a girl in mcd and we started dating i explained my situation to her and we agreed that would be best if we get married but i dont wanna pay tons of money for a lawyer yet so my question 2 you is how big do u think my chances are of getting that green card if we get married? i mean is it even possible?

Well your situation does raise a few questions, however many bad things are forgiven when someone marries a USC. I would therefor suggest the chances of getting a GC to be pretty high, assuming you and your intended bride can meet the income requirements for the affidavit of support. Looking at the bigger picture, I'm certain you'll face some tough questioning (poss. even a stokes interview) and will have to convince USCIS that your marriage is genuine, so start collecting evidence now.
 
today i red about new law in USA about illegal immigrants and that they would have 2 go back 2 their home countries and wait for papers ... so my question is if that happens am i gonna have to go back home to europe and wait for my papers when i marry my girlfriend an USC? my situation is explained above... thank you please help me

Seriously though, I'd expect a change of that magnitude to have a grandfather clause so existing cases would continue to be processed under the rules in effect at the time the application was received by USCIS. Seems like you need to sort yourself out and get the ball rolling.

When you marry and USC .You dont have to go back on any status.It is adjusted here.:rolleyes:
 
ok so nothing changed so far i have a new girl right now! so my question is do i have to get a lawyer and ow big are my chances of getting gc? i havent even been working,no felonys or whatsoever!i am clean but also out of status!
 
There are a couple of issues here that jump out. Firstly, I think a grandfather clause, if one would exist, would only apply to you if you had already applied for your GC, and the new law came into effect after your application date. Since you cannot apply for GC right away (can you?), at least, I presume, not till you are married any way, you may become subject to the new law when it comes into effect.

Secondly, you mention you met this girl in mcd - what is mcd? McDonald's? What are the chances that your relationship will last through to the point where your case gets adjudicated, which could be a few years from the date of application AFTER your marriage? With the divorce rate nowadays and the level of tolerance (or lack thereof) in the general populace in the US today, what are your chances that your case will still be valid if your relationship/marriage falls apart (god forbid)? Have you determined what your process for legalization is here? i.e. Fiancee Visa, then GC, then Citizenship etc.? What are the timelines and requirements for each step? What are the dependencies (i.s. staying together in a marriage, etc.). If things do not work out between you and your girlfriend, will you be forced to eat humble pie, againsst your will and try to stay in the relationship? considering that that would even be an option?

I would strongly recommend that you should seek a competent immigration attorney's assistance at this time to determine all your options and weigh your best course of action at this time. Your case has many facets to it and it is for these kind of cases that proper legal counsel should be sought rather than depending on advise from lay people (no offense to other users of this forum) on this forum. After all it is your life and future prospects that you are talking about here. Many immigration attorneys provide a first consultation free of charge.

I don't want to judge your character, but it seems fishy. You came here supposedly to study, the study plans fell through, you have gone through two girlfriends. It seems to me your intent was to immigrate all along. Your case looks too fishy to me. Anyway, this is probably the wrong forum. I think there is a forum for family green cards, that one will probably be more appropriate to answer your questions.
 
no i am sorry it s just a lot of things have been happening in my life after i came to US and u don t even know...i am not going to go to details but i can assure u that it has been tough...especially for young heart like mine...i still have a high blood pressure caused by actions of my sponsors...as far as i know i am not diabetic...its been tough...and NO my intent was to go back home but when u meet so many nice people and see so many nice things going on why wouldnt u try with the girl u love...

You really need to get a good immigration lawyer. That would be the best thing to do.
 
Marriage based GC is not complicated...even if you have worked illegally in the past, regardless of your current immigration status.

If you can follow instructions, and fill out forms you can do it yourself.

Be ready to prove that your marriage is in good faith, and there is no fraud. You will be expected to live together as huband and wife, and be prepared to prove that. Your spouse need to earn more than 25% of the poverty line...independently of you. You will get two year temp. Green Card, and after two years, you will have to prove again that you are still married to the same person. If they suspect fraud, you will be deported.
