Hello,
I am currently on F1 visa and had an OPT that expired on September 8, 2009. I got married on September 9, 2009 and my husband has his H1B status approved, starting October 1. I want to change my status from F1 to H4, but have some concerns:
- I know that I am eligible to stay in the country for 60 days after the end date of my OPT. Does this mean I am still in status in these 60 days?
- If I am already out of status, is it a great problem that I'm filing for change of status couple of weeks after my current status has expired?
-In the I-539 form it is said that I can still file for change of status after my current status expires if I can demonstrate that this was due extraordinary circumstances out of my control. When sending the application, do I need to attach a letter explaining these circumstances?
