I filed I-130 for my sister in August, 2005, while she was in Aupair (J1/2yrs home residentcy not apply). In Feb., 2006, my sister filed I-539 to change her J to F1 to attend college. Her Aupair ended March, 2006. Because of the pending I-130, her I-539 has been denied. My sister is already attending college and have to quit after receiving the rejected notice. She will have to leave the country within 182 days. Is it possible that they will approve her change to F1 if I cancel the I-130? Have anyone ever been successful in geting F1 after I-130 have been filed? Please advise.
