F-1 Visa Rejected twice

Hi all,

I'm posting this for my sister. Unfortunately, her student visa was rejected twice. She has secured admission to a very good program here for the Fall 05 semester. However, she can not apply again till October, which will be too late for the Fall 05 semester. She was rejected as they thought she would be a potential immigrant probably because her sister (me) is in the USA as a permanent resident. This was very unexpected because she has a US tourist visa valid till 2010 and has already visited the country 3 times and gone back on time. She is now trying to get an appointment with the Consul General in the Mumbai consulate but the chances are bleak.

My question is - can she come here on a tourist visa and then try to convert to F-1 status in the US consulates in Mexico or Canada? Has any one tried for that? She has nothing to lose any way if her visa gets denied. But can she at least get an apoointment?

I'm going to try to talk to some reputed lawyer about this, but thought of posting it here too, as I've always got good responses from this forum.

I would advise her to try one more time as an f1 visa applicant for the spring 2006 semester.When I went to get my f1 visa renewed at the US embassy in islamabad,there was one girl who was in a similiar situation.Her f1 was rejected twice and she had been to US several times and her parents were permanent residents.She got the visa this time.It all depends on the consular officer...how he/she sees your situation.
 
My student visa was rejected twice from the mumbai consulate around 6 years back. at that time there was a system of applying for the visa the third time by mail (not sure if this still happens as things have changed a lot after 9/11). So anyways, I sent an email to dean of international students that I will not be able to attend the school as I was not granted visa. they sent a recommendation to the consulate in mumbai and i applied through mail.

I had sent my application on July 26th. Got a letter from mumbai consulate on August 19th asking me to come for visa. August 22 i got visa.

Check with mumbai consulate if u can apply by mail. Also try to get some kind of recommendation from the school in US before she meets the consulate general in mumbai. it helps.....

Your sister cannot apply at the Mumbai consulate unless she resides in Mumbai or neighbouring cities which come under the jurisdiction of Mumbai Consulate. It is better to get the status converted while in the US on B1/B2, I think this is the easy way.
