F-1 Reinstatement

I'm a masters student in mechanical engineering (since Feb. 2005) from India. Due to a C grade, I was on academic probation starting Dec. '05. Due to a late grade change (I to A) I got disqualified from school (it's been changed back), and because of the long processing time in school, the International Student office terminated my visa. Now, I'm applying to USCIS for reinstatement of F-1 status. These are the facts:
1) I have officially been "out of status" i.e. record terminated by international office, since July 16, 2006, so am still within the 5 month period to apply for reinstatement
1) I currently have a GPA of 3.3
2) The international student office has issued a new I-20, as well as a letter to USCIS stating I was out of status due to a late grade change.
3) I am about to finish my Masters (I plan to take 3 units of project in Spring '07 and graduate in May)
4) I have not done illegal work or other things in violation of my visa status, and live with family.

However, I have been convicted of a crime: I was convicted of a misdemeanor DUI in Feb. 2002 while I was doing my BS

I have prepared all my documents and have taken an appointment with USCIS local office in San Jose to submit my application on October 10, 2006 (i.e 3 months within the "out of status" date)

I have heard that USCIS has become very strict and has been kicking out students seeking reinstatement even if no major violations have been done.
Is this true? What can I do to improve my situation?

I am in serious trouble, and worry all the time. Please help!

Hi,
I would recommend that you use all resources available at your school to support your case. Make use of your immediate academic advisor, your professors ask them to write letter of support explaining your situation and enlisting their support for reinstatement. Also your International students advisor could be of a big help. Hope this helps.
