F-1 Reinstatement

Dear Rajiv:

After receiving your reply on my last questions regarding the status, I followed your advice and went to see my ISO.

He immediately, gave me a new SEVIS I-20 but also told me that I should apply for Reinstatement within 48 hours. I did within the first day itslef which was on March 15, 2004.

Since then I have just received the receipt of the payment from INS and nothing else.

My dilemma starts now since I have an offer to get myself an H-1 but am not sure if i can do so before I hear from INS regarding their approval for the reinstatement.

Is it possible for me to apply for H-1? Also, if i get the rejection on this Reinstatement, can I apply for H-1 or I will have to go back to India?

Please reply at the earliest, since I am also worried about he H-1 Quota issue.

This is a second attempt for the situation i had written earlier. Today is the completion of 4 months since I sent my papers for Reinstatement.

Is it possible for me to apply for H-1 even my Reinstatement has not been approved? I have got it checked from my Advisor and the person told me that it shows PENDING status.

Also, if i get the rejection on this Reinstatement, can I apply for H-1 or I will have to go back to India?

Please reply at the earliest, since I am also worried about he H-1 Quota issue.
