I am currently on F1(master's student)OPT expiring on August 19 2006(including 60 days grace period).Since the H1B cap(master's category - 20,000) was reached in jan 2006, I would like to know whether I would be in legal status from Aug 19 2006 to 1 oct 2006(least start date of H1B for FY2007) if my employer files my H1B petition on April 1 2006 in premium processing.I am very much concerned about my status from Aug 19 - 1 OCt 2006. Please Advice me on this because I am really worried about my status. Can you also let me of what other options, like change of visa status to either F1 or B1/B2 for the interim period of 41 days.
