Dear all:

I am a GC holder, and my Fiancee is currently in the US on H-1B. She is considering changing to F-1 to pursue fulltime school. We are also planning to get married pretty soon.

What are the pitfalls with getting married and registering our marriage in the US if she decides to change to F-1 after the wedding? I am worried that it would be difficult for her to get F-1 stamping or trouble re-entering the country if she's married to a permanent resident, since she would be considered a potential immigrant. Please help!!

Thanks.

Well now...

Registering your marriage does nothing for you unless you make sure the INS knows about it, and even then they would require a copy of your marriage certificates and etc. So if you are thinking that just by being married here this would somehow propegate to the INS it wont happen, at least i havent seen it happen.

As far as her obtaining a GC based on your GC, you can pretty much forget about it, you might as well wait until you are a Citizen and then go through the proper procedure.

On the issue of going to F, it could go both ways, the immigration officer might look at it as a way to stay in the US, regardless if married or not, or he/she might look at is a way of obtaining a greater education, you are at the mercy of the consulate here. The problem with F is you have to leave the country and re-enter, and in order to do that you have to go through the consulate, even if you have an approval from here.
