F-1 Dilemma

I've recently left the US in bad fasion, but this is not the section for my story. When I left, I left behind my fiance. She has an immigrational issue at the moment that will decide whether or not she can remain in the US.

She came to the US with her family under what I believe was some kind of Church orriented visa. She was attempting for a Green Card, which they did not give her. When she turned 21, the family Visa she was under expired, so she is now illegal in the United States. She is enrolled in a University and is currently beginning the semester even though she is illegal.

One lawyer told her there is nothing she can do, but another that she was reffered to decided to file for an F-1 Visa, which will apparently be decided upon within the next three months (is this realistic?). What are her chances of getting the F-1 while she is in the United States illegaly?

Also, i've heard of some clause that states you have one year to vacate the US after your visa expires if you where underaged (you came because your parents did) at the time of entry to the US. Does this mean from the 18th birthday or from 21st?

Any input on this situation would be greatly appreciated.
