Our I-485 detail :- VSC, EB2, INDIA, RD:08/99, ND:09/12/99, FP:08/03/00, waiting for approval...Both of us took EAD once in 10/99 but never used it. Never applied AP. Currently, we are maintaining our H-1 & H-4 status. Current H-1 and H-4 stamp on passport expiring in 11/00. Already applied for the H-1 and H-4 extensions last month.

Due to the tragic death of the parents of my wife\'s 7 year old nephew, we are adopting him and want to get his name included in my I-485 petition as an adopted son.

Please give me some input on the following :-

(1) Is it possible to include the adopted child\'s name in my I-485 petition at this stage ?

(2) If yes, should the child be in US in order to get his name included in our I-485 ?

(3) Considering that we may get I-485 approval anytime, what should be the best possible strategy to save the time and get the name included before our I-485 approval ?

(4) Can we ask the INS to delay our I-485 processing so that we could complete the adoption formalities in India, get a passport for the child, & bring him to US ( probably on the H-4 visa ) if he is required to be present in the US in order to be included in the I-485 petition ?

Though I\'ll be contacting an immigration attorney for this soon, but any feedback here would highly be appreciated...

Sorry for the sad news. I wish I could give some information.
But I think it will be better for you to talk any Immigration lawyer including Rajiv Khanna.

Wish you good luck.

hi mr gabbar,
well before anything start the process of adoption because either ways you can add a dependent only if he/she is LEGALLY one. you might want to try and see what the indian consulate in NYC or whichever is closer to you might be able to do to help you out.
well i am hoping that once the adoption is clear and your case as yet not been adjudicated you can still go for the follow to join option but then AGAIN a legal advice might substantiate this advice or maybe dimiss it .

hope you get something out.

my deepest condolences.
.
