Background:
H1-B start date: Jul,2004
6 years complete: Jul, 2010
Current H1-B validity: Jul,2008-Jul,2011 (7th yr extn using approved labor + approved i-140): Employer A
Labor Approved: Oct, 2006 (Employer A)
I-140 Approved: Sep, 2007 (Employer A)
Scenario: Changing employers to Employer B.
1) Should Employer B file for LC before Jul 2009 (end of 5th year) to be eligible for h1-B extn beyond 2011? or it enough if it is applied before Jul 2010 (end of 6th year) as current visa is valid till 2011?
2) Does the fact that I have approved LC and I-140 with employer A help in any regard (priority dates, H1-B extensions) during the GC process with employer B? (no idea if employer A is going to revoke i-140, will probably do what all big MNCs do).
