Hi,

Could someone please help clear my confusion!!!

I am in USA on a L1B visa and my wife is on L2. Our I-94 are valid till July 05 but our approval notice I797A is valid till Dec 05.

Can we just extend out I94s? Do i need to fill I129 or I539? Is this like a visa extension where i would get a new Approval notice or this is just a I94 extension where i would just receive a new I94 valid till Dec 05.

Yes, you can just file for extension of stay. I wonder why your I-94 was stamped July 05 when your petition is valid through December 2005.

You can apply for extension of stay till Dec 2005. Or, in case your company wants to extend your petition period, they can file I-129.

How do you apply for an extension? Do you have to go back to your home country or U can continue staying in U.S. itself?
