hello Friends,
My current I-94 and H1 stamp in the passport are due to expire on March 4th, 2003.
I was planning to wind up my stuff in US for good sometime by June 2003.

The question is:
1) when i go to the canada border in Windsor detroit with all my stuff will i face any problems regarding the expired I-94 and US visa? . I have no intention of coming back.

I would appreciate your wise counsel in this matter.

Thanks everyone,

jaiJawan,
Ohio.

If you are currently in the US, your I94 expiry signals the expiry of your legal status in the US.

With that in perspective, you will not have any problems entering Canada (assuming you are landing or landed as a PR).

If you are planning on entering Canada (leaving US) in June, you would be without any status from March till June. Bear in mind, US customs sets up check posts randomly just outside the tunnel entrance to Canada (at the Windsor-Detroit tunnel), thereby inspecting and querying people departing the US. Although, this may be rare, if you do encounter these folks, you will have quite a bit of explaining to do regarding your non-status between March and June.

If you plan on leaving US before or on the day of your I94 expiry, you may not be able to re-enter the US without a stamped visa after March 17.

Best alternative, as I can think of, is to depart the US on March 4, 2003, surrender your I94 at the US customs informing the US that you have departed, apply for a visitor visa (if needed) at a US consulate in Canada, re-enter the US under a new I94, and then wind up and leave for good in June 2003.

I hope this helps.

Thanks for the response.

Thank you Dimple2001,
I appreciate your response.
Yes, iam a canadian P.R.
I guess, i will do as you had said, surrender my I-94 and come back on a B-1 visa.

Regards,
JaiJawan.
