Current H-1b expiring 5/17/09 (cannot extend since I failed to submit extension 365days before H-1b expiration)

Have approved I-140 (as of last week). I-485 will follow next.

Received EAD card last week.

Do I still need (and can I?) extend my H-1b now or having the EAD in my hands is sufficient to continue working for current employer? H-1b extension is still not filed. I have 17 days left in the country.

Thank you for responses

Yes, I did. Just got the appointment for biometrics for May20th. I wander how much time to approve I-485 once biometrics is scheduled.

Chronology

I-140/I-485/I765/I-131 filed concurrently 4/17
EAD received 4/23
biometrics appointment 5/20

all under EB2 (area of chargeability is "other" (europe) ) which is current now.

if you file I-485 you dont need H1b !!! Only for safe side you need H1B

i am not sure why it has to be extended or applied before 365 days ?... In my case we always applied just before expiring current H1B. May be you need to talk to attorney

Yes, I know that.

H-1b extension has to be submitted 1 year before 6th year expiration or it has to be pending for 365 days or you have to have approved LC before.
