Hi Friends,

A friend of mine was on A-3 visa and applied to transfer to B1/B2 when his A-3 expired. He has been sponsored as a cook by an Indian Restaurant. His Labor, and I-140 has been approved.

However, due to non availability of priority date, he could not apply for I-485. Now he got notice of 6 month's of B-1/2 visa being approved till March 30th, today April 5th.

I would like to know what he can do now? Does that mean he has to go back to his country or is there any way to get into a different visa status (i.e. F-1) now even though his I-94 expired 6 days ago?

This is solely due to CIS having responded too late telling his his visa was granted till the 30th of March in April. It is not his fault that he did not have a chance to change status before. He had gone to a community college and asked to be into F-1 but they refused saying he must first produce I-94 with current status, which was still pending with CIS.

if anyone has any informatin regarding this I would highly appreciate it.
