Expired H1B, Need Extension?

Hello,
I got laid off last month and intending to leave the country at the latest in the month of Augt. My H1B (i-94) will expired in June 2004. So to be lawfully stay past the H1 expiration I suppose I'll need to file an application for extension.

My question are:
1. Based on my H1 status can I received this extension?
Is the I-539 (Application To Extend/Change Nonimmigrant Status) be the correct form to fill?

2. If I can't received this extension should I change my status to B1 (visitor visa)?
