please help.
Here is my story - my EAD expires in a week. My lawyers filed the renewal petition in january but apparently they fucked it up - they never received a receipt or cancelled check and didn't action on this until I asked a week ago. So I do not qualify for interim EAD now.
My lawyer says that I have several options
1. Take an unpaid leave - I would hate to do so as it might take up to 6 MONTHS until my new EAD is ready
2. Work as is if only my employer does not come to me with this. He says that section 245(k) allows to work without authorization for up to 180 days... I don't want to be engaged in an unauthorized employment!!! I worry that I might not be admitted to the US after that, this section does not protect me from inadmission, does it??
3. Apply for H1. I had H1 in the past, with another employer (not my current one) and I started to use my EAD 17 months ago. He says that I will not be counted against visa cap (this is true) BUT I will most likely need to go outside the US to apply for visa and re-enter US to "activate" my status. WHY IS THAT? When I got my first H1B I was switching from H4 and never left the country and never had H1 visa in my passport
I like this option the most cause it's legal, and apperently you can get your visa in Warsaw pretty fast (1day waiting 1 day processing). But what if they start administration/security check???????? Will I be hold in Poland for 30 days???
Anybody please advice, what do I do? I feel so frustrated i don't want to live
