Expiration of I-94 & Valid EAD and AP

My H1 Visa expiring on 03-Jan-2003 and my I-94 is aloso expires on 03-Jan-2003. I last entered to US thru H1 visa. Now I have valid EAD and AP till Nov'2003 and I-485 is pending since more than a year(Nov'2001). My question is..
If I go to out of this country after my I-94 validation time i.e 03-jan-2003 , is it OK to submit my expired I-94 card at the time of depature??? or I have to go out of this country before 03-jan-2003 and re enter using AP???
 
You can go anytime without hesitation before or after your I-94 expiration as you both are already having valid EAD and AP. It does not really matter. While entering back you need to enter using your AP and hope you are already working on EAD or you can change to EAD before leaving.
