Hello,

I am extremely worried about the issues related to Change Of Address. I am currently in Upstate New York working on contract for one of my Company's (which is based in Boston) Client - I have been using my friend's Boston address (who has the same surname as mine). Now I already have receievd my EAD and AP (as at that time I was in Boston). But my wife's process has run into lot of issues - Here are the facts -
1) She has a different surname. Her Ead got approved and INS sent her EAD Card to my friend's adress but it got returned back. This happended almost 3 months back. Now it seems that I would have to reapply for her EAD? I am thinking of trying out infopass as I have her EAD approval notice but I am not sure if they would issue her EAD Card there and then? Please suggest the best course of action and alternatives? Also is it OK if I do not apply for EAD card at all - it should in any way affect her's or mine I-485 approval process - right?

2) There was an RFE issued on her AP which INS sent out to the lawyer - but he did'nt received it either - I do not have any travel plans for the next 6 months - Can I just leave her AP thing as it is an bother about it after 6 months?

3) For the time being I am here in Upstate New york for another 6 months - do not know where I am going to be after that. Now I have heard ugly stories about COA from one state to another (mine being from MA to upstate NY) - case files getting transferred - process getting delayed by years. I cannot continue with my friend's address due to various reasons - besides thae fact that he would be moving in the next 3 months, it seems it will be too unsafe for me and my wife's I-485 INS correspondence - I do not wan't anything returned back to INS and then again getting lost. What should I do - I think my prioiry date might become current in the next couple of months - Should I go for COA at this stage? Would it be safe? I am extremely worried about this - it took me extreme pains to get to this stage - (have literally wasted 4-5 years of my life) - and I cannot afford my process to get delayed any more - as if I do not get my GC within the next couple of months I might end up back in India. So experts please help me making the right decision wrt the safety and time constraint.

4) It's time for me to renew my EAD - But I am again bottlenecked by the fact that should I first do COA and then apply for renewal. Also should I get another friend's address who is based in Boston on a permanenet basis or should I give my temporary Upstate NY address.

5) My I-140 still has'nt been approved and I am wondering that if I need to go for COA than it should'nt effect/delay my I1-40 process? Am I right?

6) So I need to renew my EAD, have to apply for my wife's EAD and AP again, and then there is I-485 process - for all this should I be going for COA at this point of time when I am about to get my I1-40 approval and my prioiry date might become current in the next coouple of months.

Experts please help. This COA issue is killing me. I am having a lot of sleepless nights. Also if I need to go for COa - then what are the steps I should take care off. Any help greatly appreciated.

Thanks

Thanks unitednations for your response.

How did you finally got your wife's EAD - did you re-applied? As I have been calling INS for the past 3 months - but everytime I call them up they tell me to wait another month - on the other hand lawyer hs been insisting to get infopasss appt. or to re-apply - so as per your case scenario my lawyer does know the facts - as he has been telling me to try out infopass?

....may get an RFE later for paystubs w2's, etc. for USCIS to determine whether wife may have worked without authorization....
What you are suggesting is that if I do not re-apply for EAD - and she does'nt work at all - even then we might get RFE for paystubs/W2's !!! But whose paystubs/W2's would they ask for??

....There has been people who have gotten RFE that said your address is xx but you are working at xx, please explain.....
My sponsoring company is based in Boston - and for GC purposes I have used Boston's address. But for the past couple of months I have been working (and living) in Upstate New york for one of our Company's clients. I might have to spend another 6 months at this location. I cannot use my Friend's Boston address anymore as he would be moving pretty soon - But I have another good friend in Boston who is going to be there for a long time - Would it be safe to use his address. The #1 reason for me being reluctant to use my Upstate NY address is that I have heard of cases where the case file get's transferred to "Buffalo local office" and the process gets delayed considerably, also I am only there uptil end of April 2006. Now I am expecting that my Prioiry Date is going be current in the next couple of months - and if I go for COA from Boston to Upstate NY than I might get screwed. I know that giving my Upstate NY address is the right and safe thing to do - but there is a huge risk of file transfer - and I cannot afford to have my process delayed. Please suggest what you might do if you were in my shoes? - risk and delay trade-off!!

I have'n t yeat submitted my wife's medicals yet - as the lawyer is suggesting to wait for a Medical RFE on her case. Now I am wondering if her case and this RFE later on is going to affect my case - so if my priority date becomes current and if I am supposed to get my GC in the next month - would I won't get it if I receiev a medical RFE on my wife's case???

About the COA - please put yourself in my shoes - as once I go for it there is not turning back.

Thanks

Thanks unitednations.

My Priority Date is October 2000.

.....If you had an LCA for h-1b in boston and new york then you may be safe to maintain boston address. However, if your LCA is only for buffalo then you would be better served to change your address to where you are working. USCIS can/does look at h-1b lca's and match them up with where you worked and where your address was.....

My GC Sponsoring Company is based in Boston - and my H1B and GC both were filed from Boston (Vermont Service center). It's just that I have been working on Contract for the past 6 months in Upstate NY for one my Company's client - And the contract with client is going to be ending in April 2006. And when that happens I might end up moving to some other state depending upong where my Company places me. Now since my job situation is such that I have to move every now and then, I thought that it would be better if I use one single address and never applied for COA. If I apply for COA (from Boston to Upstate NY) within the next week would everything be fine - do I need to do anything else. My Company sends me my paystubs at my NY address. Also this year I will be filing for NY State & Federal Taxes. Please let me know a good solution to take care of this mess I created for myself unknowingly. Thanks.
