Hi

I got my H1 in Jan 2004. My husband has been refused H4, and so I have to go back to India.
There is a company B that is ready to do my GC. I am talking to the lawyer to start the process and I will go back.

The lawyer has advised me to apply for the H1 again from this company B after 6-7 months, so that I will be counted outside the cap. Is that true?

my question is after what stage of the GC can we come back here, if the H1 after 6-7 months is refused?
Any advice is greatly appreciated.

Only after your GC gets approved.
