Hi,

My case has been forgotten by INS since they received my response to a simple RFE on July 9th. I called 3-4 times since then same old song....should hear in 2-3 weeks. Now it is more than 4 months. So i tried to convince my lawyer to contact through AILA Liaison but he was hard to convince. He thinks we should only do that if my RD is 4 months behind the INS published processing date(which is currently 9/15/2001) irrespective of RFE date. So i contacted my local congressman asking help. He wrote back asking to send him privacy act waiver notice so that he could reprasent me. I sent the same.

The question is do i need to inform this to my lawyer ? will there be any problem if i don't tell him the fact that i have written to the congressman?

any Ideas or experiences will be appreciated.

Thanks

Case details:

RD : 08/27/2001
ND : 10/16/2001
RFE: 06/25/2002 (2 W2s and 3 paystubs)
RFE received by INS: 07/09/2002

WOW 156 views but no replies?

Looks like it is more complicated than i think. Experts any advice?

Just Kidding earlier, my 2 cents

Hey Man

uh..I am not a lawyer and this is not legal advise, rather this is an arrow in the dark. Anyway my 2 cents
- Whenever you hire a lawyer to represent you for anything - I do not believe you are in any way BOUND to share all hte information related to the matter. Ofcourse sharing everything with your lawyer usually helps, and not sharing some info may jeopardize your case.

However in your particular case....
- you seem totally justified in pursuing your case through local congressman (though from the past post my view has been lil' pessimistic about this approach)
- as for not sharing this info with lawyer, uh just weigh the pros and cons

dang..hit Submit by mistake...rest of msg

..pros and cons..you wiegh it yourself, here are musings of my mind alone..
-if you do tell him, what ? He might get upset
-if you do not tell him, I don' think you have breached any moral/legal contract...he might take slight if he/she finds out later.

Eh..that didn't help..did it. Anyway I tried.

Thanks AVI Singh

Thanks for your thoughts. There were couple of cases before who approached through their congressmen and said it worked. If any of you still around here would you share your experience on this regard.

Thanks

No problem..

Hi Kalluris,

I don't think you should let your attorney know that you have contacted your senator.

Many people have done that before and I see nothing wrong in you also trying the same.
Worst possible scenario is it will be transferred to Local INS office. It helps in your case at least you will get an interview soon and get approved rather than wait endlessly.

Good luck Kalluris
