Gurus....

I am working on EAD for almost 9 months. I H1-B expired on 07 March, 2003.

I only used 3 years and 5 months of my H1-B, though I am in US for about 5 yrs. I studied here and got the H1-B sponsorship while studying.

My 485 is pending (ND November, 2001, FP in Feb'03.)

What are my option to go back to H1-B if I want to use the rest of my H1-B timeframe. (6 yrs - 3 years and 5 months = 2 years and 7 months).

I know, I can renew my EAD as long as my I-485 is processing.

Just want to know, is that option is still open for me or not. Can I do it from US ??

Any good lawyer, I can contact to for this kind of cases.

Any suggestion would be highly appreciated. I heard different things from different group of people.

Thanks in advance.

no options other than working on EAD

Once you start working on your EAD, your non-immigrant status is gone. You cannot go back to your H1 status anymore, except you stop your GC processing with INS, step out of US and come back after 1 year. For more accurate information you can contact your lawyer or GURUs here.

I think u can return on H1 back

I have my H1 extension petition approved. My H1 visa in the PP is expired and I have EAD and I am using it now. I plan to go to my native place for vacation, apply for H1 visa and comeback on H1 visa. I am not going to Use EAD after my return with H1 B visa.

Please corrent if I am wrong.

What was the reason you used EAD when you had H1 extension applied/approved while working for the same employer?

Once you have used EAD then you are no longer on H1 and hence should not try to get H1 visa in your home country. You can not switch between H1 and EAD. You will have to use AP to come back to USA.
