I am working on EAD for almost 9 months. I H1-B expired on 07 March, 2003.

I only used 3 years and 5 months of my H1-B.

My 485 is pending (ND November, 2001, FP in Feb'03.)

What are my option to go back to H1-B if I want to use the rest of my H1-B timeframe. (6 yrs - 3 years and 5 months = 2 years and 7 months).

I know, I can renew my EAD as long as my I-485 is processing.

Just want to know, is that option is still open for me or not. Can I do it from US ??

Any good lawyer, I can contact to for this kind of cases.

Any suggestion would be highly appreciated. I heard different things from different group of people.

Yes you can go on H1

You can get your H1 renewed but for 6 years minus your stay in USA. It will be less than 6 years minus 3 years 5 months.

But after that you can get renewed H1 like EAD every year.

All the lawyers will do this case, I could give you name adress of my Detroit based lawyer, but you may find others as well.

Hope this resolves your querry. My suggestion it is better to have an H1 in hand.

You mean "Stay in US" or "Working on H1-B in US".

I am in US for 4 yrs and 10 months. I studied here and while studying, I got the H1-B sponsorship. I worked on H1-B for 3 yrs and 5 months. After that I didn't renew it. I changed company and now I am working on EAD in another company. Next month, I am going to apply for my 3rd EAD.

If needed(for any reason), can I switch to H1-B, with the same company or in a new company. Will it create any problem to my GC processing ????

I would highly appreciate, if you please let me know the address of your lawyer.

Any idea, how much they charge ??

let us go one by one

1) Your H1 can be renewed for up to 6 years, total stay on or after issue of H1B. In fact date stars from the day you enter country on H1.
2) You can apply for H1 for the new company, you are working for.
3) Hope your job in the company is not too different from the job, based on you got your first labor certification for GC. If you change it drastically it may be a reason for concern.

So in my case

1. How many days I have left for my H1-B. If it is "after I enter the country" then it is only 1yr. 2 months right. If it is after H1-B approval, then it is 2 yrs 7 months.

2. If I apply to new H1-B, it can be "any area" right, I mean irrespective of my Labor....

3. Right now, my job description is pretty much similiar, through the salary is little bit less.

I am really sorry for asking a lots of questions.
