Expert, please help on possible EB2(RIR) rejection because of company had layoff

I am applying for LC on category EB2 RIR. My COMPANY lawer told me that my case will be more than likely rejected because
that DOL found the company I am working for had layoff this year. He told me that I should change to EB2 NON-RIR.

Can anyone help me on this? What should I do?

Don\'t do RIR if your company has layoffs. My company had layoff and the case has been remanded to SESA again from Chicago DOL.

My lawyer too...

My lawyer says that they received quite a large number of applications for my positon and that its not wise to file RIR.

I am confused as i dont know if i have to wait for a few more months or do the non-RIR way. I think that the non-RIR way can take almost 3 years. I have about 4 years of my H1 left.
