Experience/Termination letter

Do we need experience letter from previois employer for filing Labor Cert or atleast at I-140/I-485 Stage.

My First consultaing company in U.S is not willing to give expereince or Termination letter and advised its not necessary to have experince letter.

I got the offer letter from this company and also the PayStubs (Latest paystubs frm this company for sure)


Please advise..

you need previos company experince letter for I-140 to prove your experience mention in labor certifcation. sometime lawyer asked for experience letter before they start labor as standard procedure as they get exact and sure information how many years of expereince and what expereince required for the job advertisement publish, so later on there won't be any problem.
You can get letter from your immidiate supervisor, who is or is not with same company now, sometime co-worker letter works. but you don't need to have letter from that company (or company's latter head), if you have that great, other wise it won't be problem.

You need your current company letter stating at I-485 stage saying you are still with comapny and they are still intend to hire you after i-485 finish to prevent REF in future.

The Previous Consulting Company I worked with is a small company. I got an Offer letter from them back in Sep 1998 and I came to U.S on H1B thru them and Worked for over 2 years. I worked on 3 Projects (Clients) thru them. Between the Projects I was on Bench for 1 to 2 Months for which they didnt pay me any sal.
Later I gave them a Verbal Notification that am leaving them as I got another Opportunity. They said yes and also did the pay the sal for that month I worked with CLient without deducting anything. Later on I moved to a different Company for which I got the experience letter.

Only thing I've from the First company in U.S is Offer letter, H1B PhotoCopy and Paystubs.

But also the Client's(last Project thru above company) Reference Letter that I was ij contracting role with Client and did excellent jobs supporting and maintenace of their Software left the Client at Feb 2001 for pursuing other contracting opportunities.

What should I do? I kept on asking for Experince letter or atleast Termination letter. They said that they spoke to their lawyer and they need not give any experience letter.

Whats the alternative?

Get a letter from co-worker/immediate supervisor - that will work. Also use pay-stubs and client letters for better measures.
 
Is there any particular format for experience letters that we should use? Especially if it is from an ex-colleague, not supervisor?
