Experience Questions?

Hi ALL.
Hope everyone is doing well.
Thanks guys for the supporting threads to all immigration law issues.
For my case (as EB2), the job description in the job order is saying 3 years of experience. I have 3.5 years experience when doing my Ph.D. as a research assitant (20 hours per week), is this enough to be taken as 3 years of experience since the requirments for the job is only MS and I do have a PhD?

20 hours per week is half time. Thus, 3.5 / 2 = 1.75 years of experience. IF it is accepted, as this is a bit grey area.

Could you please elaborate on what you said when you mentioned grey area!!! Is there substitution of experience by education! Since the requirement for the position is MS and I have a PhD.

Well, I said gray, because our lawyer refused to count experience during graduate study as work experience. My husband spend 4 years in Masters program (which is 2 years full time work experience) but we will not use it in his PERM. I know from the board that it could be used and I asked the paralegal assigned to our case directly about that. She said that using experience during graduate studies creates so much problems and questions that they rather not do it.

About the second question. I don't know if you can use Ph.D. as a substitute for Masters. That is a question for your attorney and the paralegals. Hope you have Masters before the Ph.D...

Unsure is correct -- if you worked 20 hours a week, it only counts as half time, so you would not qualify for that job. The fact that you have a PhD is no-nevermind to make up any extra time needed.
You're going to have to either be able to document some more experience or start over requiring less experience.
