Experience letter for I-140

Hi,

I got my labor Approval and i'm ready for applying I-140.
My labor requirement is atleast 3yrs of experience in Web technology with VB6.0,Oracle,XML,HTML etc.

I have 2 questions.Gurus please answer me.


1) i worked in different technolgies in my previous companies.
i have experience letters from my previous employers for 35 months
which exactly matches to the ones(VB6.0,Oracle,XML,HTML) mentioned in my labor.
But i also had the experience letter for about 2 yrs in client/server technology with VB,Oracle
without XML,HTML which i didn't use.

is it going to be a problem for I-140 as i didn't use XML,HTML for these 2yrs?


2)I have experince letters from all my previous employers except one Company A.
I worked for company A from May 2002- Dec 2002 in some internal project
which i didn't get paid from May 2002 - Sept 2002.i got paid from Oct 2002 to Dec 2002.

I did mention in my labor that i worked for company A from May 2002- Dec 2002.
So company A agreed for giving experience letter only with the dates from Oct 2002- Dec 2002 ,not from May 2002- Dec 2002.
Moreover i don't know anyone from this company in order to get experience letter
from co-worker.

is it going to be any problem with my I-140 as i don't have one experince letter?
 
Are you applying in EB3 (or) Eb2 ?. What is the skills and experience mentioned in your Labor Certificate (LC) ?. If you give that details...it will be easy to answer your question.

How would i know whether mine is EB2 or EB3.
I guess mine is EB3 as my Laber Advertisement requires
3 years of Web Dev using VB6.0,ASP,ADO,HTML,DHTML,CSS,JAVASCRIPT,VBSCRIPT,ORACLE.

I mentioned all my previous experience(i.e 1995-2002) in my laber certification as follows

First Company -- Visual Basic,Oracle,RDO,Window 95 (2 yrs)
Second Company -- Oracle,COBOL,JCL (1 yr 2 months)
Third Company -- VB6.0,ASP,ADO,HTML,DHTML,CSS,JAVASCRIPT,VBSCRIPT,ORACLE (1 yr 6 months)
Fourth Company -- VB6.0,ASP,ADO,HTML,DHTML,CSS,JAVASCRIPT,VBSCRIPT,ORACLE (1 yr 5 months)
Fifth company -- This is the one Company A which i didn't get paid for all months
but i mentioned in my labor from May 2002-Dec 2002.(8 months)
I worked in the same technology(VB6.0,ASP,ADO,HTML,DHTML,CSS,JAVASCRIPT,VBSCRIPT).

Sixth Company -- I joined this company in Jan 2003 and Feb 2003 they applied for my labor.
 
As far as I know, you can submit all your experience letters even though the technologies did not match 100%. Mostly attorney's looks for atleast three common technologies listed in Exp letters are thre for the period mentioned in Labor. You are good. Just submit the ones you have that should make 36 months (3 years). Do not usbmit less than that and not worry much about technologies listed in LC.
 
is there a chance that they can send RFE for exp.letter of company which i don't have eventhough i met labor requirement?
 
No need to worry!

Hi skpkv,

Perfectly fine. Just submit all the experience letters whatever you have which are genuine. It's EB3 and the required experience is 3 years. You have more than 5 years exp. You should be fine.

I-140 is related to the company. Make sure that your company submits all the up-to-date finanical statements, their tax returns, offer letter/EVL etc.

From your side you should give...

1. Experience Letters (All)
2. Last years W2 (or) from the year your labor was filed
3. 2 Recent Paystubs
3. Degree Certificate
4. Educational Evaluation
5. Signed ETA Form 9089 (Original)

I hope this info helps you. Take your time and apply I-140 with all necessary documents.
