Just got a response from USCIS on my request (sent a few weeks ago) to expedite case WAC 03 057 53**.
The response "The service is currently processing cases that were filed on or before March 1, 2002. This case was filed on Dec 11, 2002"
Even though the applicant's fingerprints will expire, at the time the case becomes current, the applicant will be rescheduled for new prints.
There is no qualified justification for an expedite at this time."
Please allow ninety (90) days before enquiring on the case status."
Well, it was a shot in the dark anyway. After I saw a few cases get approved with same ND and NDs around mine, I thought it might be worth a try. The cases approved were concurrently filed but mine was not. My fingerprints are expired and it looks like they will be rescheduled only after JIT hits my ND.
One thing that bothers me is that, no matter how much I study USCIS's policies and try to make the best case out of it, as time goes by, USCIS seems to take an about turn on it's “policies”. Case in point, I had concurrent filing available to me at the time I filed my I485. INS has given an “opinion” at that time that applicants using concurrent filing may not benefit from AC21 to change jobs. I felt that having the option to change jobs was more important in a lousy job market considering the fact that adjudication was taking about a year (at that time). However it seems that applicants who filed concurrently not only got the benefit of rushing their I485 in, but also got them approved faster too.
My last updated dates haven't changed even after I received this snail mail.
