Ex-employer not giving W2 for 2005

I have transfered my H1B to a new Employer. My ex-employer has not yet sent me the W2 form of 2005 in spite of my requesting him for the same. How long should I wait for my W2 from the ex-employer and What action can I take in case the ex-employer does not send the W2?

If w-2 is not sent to you by 31st January your employer can be reported to IRS
