Hello folks,

I was called by Immigration officer this morning. They wanted me fax in the EVL today. Could anybody provide an EVL sample to me? And what should I pay attention to when laying out the EV letter? Any suggestions are appreciated. Thanks a lot.

------- Change names and modify as u needed. use TSC-USCIS or just write simple TSC-USCIS. and if u don't feel comfortable just use 'To Whom it may concern' General purpose EVL letter.

Re: Adjustment of Status of John Roe

Dear Sir or Madam:

This letter certifies that John Roe is a full-time regular employee of ACME, INC.. He is working in the capacity of Software Developer and he receives an annual income of $XX,X00.00 annually. ACME will continue Mr. Roe employment while the application is being adjudicated and permanently afterwards, not negating the company’s at-will policy.

Please call me if you have any questions or require further information.

Very truly yours,

Jane Roe
President

Hanz,

I got RFE for EVL, but the RFE came to my Attorney who sat on it for 30 days and then send it to me. It seems you are special as Immigration Officer is calling you beside sending the RFE. Are they trying to be proactive? I hope so, in that case, my 485 may get touched...

Good Luck

11/2002 approved

Hi, here is the update of my case processing:

I got the call from a TSC officer, who intended to approve my long-await AOS, asking for EVL and birth certificate, which I had enclosed with the application package, on 5/25/2005. The officer talked very nicely;

After faxing EVL and birth certificate to TSC on 5/25/2005, I got another call on 5/26/2005. The officer said all docs were ready and promised to approve our cases in that afternoon.

On 5/27/2005 (Friday is always the time TSC sends out new emails), online status showed all the cases were approved. A moment of relaxation.

Case details:
I-140/I-485: Nov, 2002;
I-140 (EB-1(a)) AD: Aug, 2003;
FP: Sep, 2004;
I-485 AD: May, 2005.

I have been handling all my petition/application by myself. During the whole procedure, I always got help online. This forum is one of the websites that I got help most, including sample docs, related laws and spiritual inpiration. Thanks a lot, forum.

Dear B.B Jee

I hope u don't mind, it was joke :D .

It seems Mr, 'Hanz' was really lucky, and TSC are also aggrissively in rush and cleaning 2002 queue. not all 2002 are luky but atleast he is.

I also understand that u responded ur RFE in Dec04 and still waiting, since u filed in July03 it may be possible ur file in queue and abs ready for adjustment any time.

Btw did u get chance to learn about ur Name Check done?

Good Luck

BanglaBabu,

Hi, I mailed expedite request once more one week before I received the call. The difference was that I mailed it certified other than a regular one as I had done before. At the same time when I mailed the letter to TSC, I also sent a letter to Senator at Dallas who helped me get FP last Sep. I believe it was my expedite request letter worked this time since the Senator's office might not contact TSC immediately (maybe I am wrong at this point). With the mail to TSC certified, I was able to track if it has been delivered. The mail was delivered around noon that Monday. I missed the call on Tuesday eventhough I got my cell phone with me and I got it Wednesday morning.

It might be a good advice to provide a telephone number that the officer can reach you at anytime, if they want, in your letter of expedition request. The officers wouldn't like leaving a message, nor being called. This is a at-their-will deal.

All I said is based on that your case is good: FP done, Name check cleared, Time overdued, some slight materials likely missed (even though not missed in your initial application package). Under this situation, you might receive a call following expedite request.

Good luck, man.

Should EVL be issued by current employer or sponsoring employer ?

In my case, I changed my job but my sponsoring employer will not be cancelling anything.. I worked with them for 4 years... and now taken full-time position at client's. Client also did H1 even though not required...

If I receive RFE who should give letter...?
