EVL format Question

I am modifying what my lawyer sent me as HR refused to sign it - lawyer's format mentions that my salary is higher than LCA salary and he is forcing me to get a pay hike - which is not possible.
If the modified format is acceptable, i can ask my HR to sign this as it gives the facts.

Is it OK to send this EVL - my salary is 10% less than LCA salary.

Is this job post AC21? In which case 10 % less is not a criteria and will pose no problems.

If not, what was your company thinking by paying you a salary less than what is claimed on LCA? Is it possible for you to reduce the 10% gap by including bonus, options, etc? Is it possible for the HR to offer to pay LCA salary upon approval?
 
Oh post AC21 absolutely no worries on salary. There is no need to lie or force HR into doing so. The AC21 specifications are perfectly okay with lower salaries as long as you don't make extremely low salaries that verge on putting you on dole.
