Evidence to verify skills, Please help!!!

Hi,

Here is my information:

I graduated from a US college on Dec 1999, with a major in MIS and a minor in Computer Sicence. I joined my present company since August 2000. This is my first full-time job since 2000 to present. Here're my job titles in the same company:
- Aug/2000 to Oct/2001 Release Engineer
- Oct/2001 to Oct/2005 Software QA Engineer
- Oct/2005 to present Senior Software QA Engineer

Labor RIR:
- EB3, U.S. Bachelor's Degree + 0 experience
- PD November 2002
- AD June 2006

I-140 question:
My lawyer and I are preparing to file I-140. My lawyer said that USCIS has been requesting that we submit evidence to verify the following exact skills:
"software test methodology, software release process, Windows operating platforms, and setup of client/server structure for testing purposes"

My lawyer told me that: " need to submit evidence that you qualify for the RIR position and a letter from your present company will not be considered acceptable evidence since you need to show that you possess these skills PRIOR to joining your present company".

Since this is my first and only full-time job, I don't have any prior work experience to prove my skills. So, my lawyer suggested that I request a letter from my University professor to prove that my course works and projects show the above exact skills and wordings. I have trouble contacting my former professors since this is a Summer break, and some of them already transferred to another college.

I also heard (from another forum) that "It is possible to use experience gained with the sponsoring employer, so long as that experience was gained prior to the date the LC was filed. One would need an experience letter from the company showing that employment". Since my LC was filed on Nov/2002, can I use my experience from Aug/2000 to Oct/2002 of same employer as evidence to prove my skills?

Does anyone out there have the same problem when filing I-140? What did you do? and Is your case approved?

Please give me some advice!

Getting an experience letter validating your background is a crucial step for i140. I have not heard of anyone who provided experience between the date of joining and the date of filing LC, as a valid "prior" experience.

In my opinion, there are two methods that you can follow:

1. Follow the route and see what happens. There are a lot of cases where one has been with a single employer for considerable time.

2. Provide employment letters about experience overseas, aka, your home country.

3. Obtain affidavits from fellow coleagues (in your case, from school - lab incharges, other professors, fellow students, etc) to attest that you do have the right skillset and background.

Please discuss these options with your attorney and employer. There are lots of opinions that can fly by in these forums. Ultimately its what and how your attorney projects is what that matters.
