Estimated time for GC Approval

Hi Friends,

Mine is a future employment case. I am not working with sponsoring employer currently. I am currently working with a different company on H1B since i have still 2 1/2 years of H1 period left over.

I have filed my 485/EAD/AP/FP/I-140 with RD 12/04/2002. Thing is my sponsoring employer want to get some benefit out of me. Its a small company with very few no. of employees. He asking me to pay 1000$ per month( non-taxable) till i get my GC approval.

But based on current pace of Vermont approval i am not sure when i will get the GC approval.

Can some one shred some light when roughly Dec 2002 cases will be processed by Vermont.

By May 2004 I will be completing 540 days after filing 485. Is it taking more than 540 days for any one in Vermont to get GC approval?

Predictions won't work with VSC. They will go in their own pace. I have seen lot of cases in December 2001, not even touched.

It is very difficult to guess.

I would say it will take another 1 year. It can be less or more or who knows. Best of luck.
 
If it is possible, why don't you change your current employer. That should be your best bet. On going forward he may trouble you more or ask new demands.

Since your are not with one who started your gc, try to find new one.

once your i-140 approved count 180 days from..

once your i-140 approved count 180 days from the RD of your I-485. after this day you are automaticaly eligable for ac-21,and you can offer your employer to kiss your a..... :) your RD is 12/04/2002 more than 6 month ago - so try to pool time until your i-140 approved (hopefully soon) and then you free
 
Thousand dollars per month is a lot of money and I don't know if the GC is worth that much during these difficult times. As everyone said, search for a new employer or talk to your current employer and see if he agrees you as a contractor. Or better why isn't your current H-1B employer sponsoring your GC?
 
option(1)
stall the sponsorer till you get your I140 approval.
once you get that, use AC21 to move to some other company.
you can do that since it's been more than 6 months since you've applied for I485

option(2)
if it is an alsolute must to pay your sponsorer.
move your current contract to your sponsorer.
$1000 per month cash, translates to roughly $10 per hour billing.
iam sure you must be generating atleast that much for your current H1B holder.

again, just my thoughts.

I am working on H1-B with a company on 50$ per hour rate. This employer is different from Sponsoring Employer.

But now sponsoring employer is asking me to either join with him on 75 - 25% basis or pay him 1050$ personal check to him per month.

The caluclation i made is if i stay with current employer only instead of moving to sponsoring employer. The total salary i will getting is 50 * 2080 = 104000$. After taxes i am getting 72,800$ per annum i.e. 6,066$ per month. Then in that i need to pay 1050$ per month. So basically my salary is 5016$.

If i start working with sponsoring employer my salary befores taxes is 104000 * 75% = 78,000$. Out of which i need to pay taxes. Then the net income per month would be 4680$.

I thought like choosing sticking with current employer and paying the sponsoring employer 1050$ look to better.


Regarding applying for portability the current employer is not willing to do portability. I need to find some one who can do portability. Unfortunately i don't know any one who can do that for me. Also even if i do portability the new employer expects me to work with them or expect some kind of benefit out of me.

Tell me what should i do in this situation.

In case of moving to sponsoring company, you will be moving from W2 to 1099 (Corp-to-Corp), your current employer will save 12% on the employer tax, therefore they should automatically increase your rate to $56/ hour (50*1.12)

Do the calculation again, and in the end you might find switching to sponsoring company as a better option.

Initial rate i joined with current employer is for is 45$. I explained the current employer about the situation with my sponsoring employer. Then intially current employer said they will give 50$ if join the sponsoring employer because they will save their taxes. But i requested the current employer and made my rate revised. So now they revised to 50$ even if i stayed with them.

so there is no scope of me getting 56$ if i work with sponsoring employer. Current employer will give same 50$ even if do corp-corp with sponsoring employer too.
