Error in the Electronic Diversity Visa Entry
Dear friends
I need your help.
I am new in this forum and I write you from Spain,well, I have been selected on the dv lottery for further processing.. my case number is EU20XXX, well when I was applying for the first time I put single on marital status, as I have no contact with my wife since 2011 (she moved to another country) and we are planning to get divorced by the end of this year, I didn't think at that moment that this information is of major importance and I may be disqualified because of this error,I put single because I did not have her picture and her general info,I've been told that you can't go on with the process if you don't uploqd her picture, it says error when you try to include her without picture, is that true? so I would like to know if there is any possibility that I could fix this problem? can I send the forms as single, to they investigate if you are married and that stuff? do I have to call KCC and explain this to them or just the embassy here in Spain? I don't have time because I need to send the forms asap, please any advice from a laywer here or someone with experience, I've been told a lot of information.. like you are already disqualified and that stuff.. Thank you in advance
 
I'm not sure what to say. The instructions are clear:

On your entry, you must list your spouse (husband or wife), and all living unmarried children under 21 years of age, regardless of whether or not they are living with you or intend to accompany or follow to join you should you immigrate to the United States...
Failure to list your eligible spouse will result in disqualification of the principal applicant andrefusalofallvisasinthecaseatthetimeofthevisainterview. Youmustlistyourspousehere even if you plan to be divorced before you apply for a visa.

According to the above, you are disqualified. You can take a risk and apply as single, but if they find out that you have lied on an immigrant visa application you will be banned from any travel to the US for a long time (I believe it is a 10-year ban?)
