Error in I140 - what to do?

Today I received a copy of the I-140 application submitted by the University International Services. I noticed that in Question 1 of part 4, they have mistakenly put INDIA as my last country of permanent residence in place of my home country. In all other places they put the correct country and citizenship, though.

How big is this error and what can we do about it now? honkman, eb1doc, chipman, united nations, sandy,....and all gurus, pls. reply.

I am not an expert for issues like this but I would say that this might be a pretty significant error since at one point in the GC process you will part of the FBI background check and I think something like this might bring up issues which could slow down the process significantly. Inform the University International Services that they should contact theor attorney and he should know how to fix the problem by contacting USCIS.

Thanks, honkman. I contacted the University official and got this reply-

"However, that section is really not required to be completed for people applying for adjustment of status. That section of the Form has been a point of confusion for awhile but Immigration has gone on record saying that its only required for those asking for consular processing ........ If you noticed, I checked "plans to adjust status in the USA" That's the most important question for you in that section."

I called the national customer service and they said that the only way they can fix it is if the employer calls. I asked the official to do it but he wouldn't. His reply: "I really don't think its going to hurt anything. If you are really worried, ask the lawyer who did your labor case to see what they think and if they know of any strategies to fix it."

Any comment?

As I understand in that section you need to check only ONE.

If you plan to do adjustment of status you need to give last address abroad.
if you filled (checked this one) in this info correct then you are fine.

If the mistake is such that you cheked consular processing and wrote wrong foreign country....then you need to rectify it ASAP. If you haven't checked this one but entered wrong country here...then there is good chance they will ignore it!

What they did is they checked this one but provided incorrect info (wrong country) for the permanent residence abroad.

I am frustrated! My "special handling" labor case, which used to take about 3 months, is sitting in the backlog center for about a year. Now looks like this OR case is screwed up because of the dumb mistake this official made.

I am not an expert in this..but I think you can set it right when you submit your I-485. Probably you should submit it along with your I-140 or at the earliest.

If you talking about I-140, your employer should directly contact
the lawyer and rectify it because your employer is the petitioner.

I'd be very surprised if my employer would not do it for me.

By the way, didn't you have a copy(and draft) of the petition before
you signed off ?

They do not have a lawyer. They do it by themselves.

I am not supposed to sign the I-140. It is a petition made by the employer.
