Entry with 3 weeks left on H1 Visa

Would there be problem in India or at US port of entry, if you have only 3 weeks left on the H1 Visa?
We are planning to comeback and apply for extension immediately under premium processing.

no problem. better if you could get a letter from your employer that they intend to file extension as soon as you enter. btw you can file regular or premium but it SHOULD reach (business day) uscis prior the i94 expiration date.
