Hi All,

My 485 was applied for in Jan 2002. My first EAD expired in April 2003. My H1 has expired in July 2003.

Since Feb, I left the US to work for the company in India. I have no intention of returning back to the US.

I do have a valid AP though till early 2004.

My question is : If I have to visit the company for some work, what is the best way to do this ?

1. Can I travel on my AP. If yes, how to explain the stuff to the Immigration officer at the port of entry?

2. Can I give up my GC process ? If yes , could someone fill in on the exact procedure ?

3. Can I apply for a Business Visa ?

Kindly give me necessary details.

I don't think so, because you've pretty much abandoned your GC process.

I don't think there is any exact process for it.

3. Can I apply for a Business Visa ?
That should be the way to go.
 
my 2 cents

If your company has branches in both US and India, you can apply for L1 visa (intercompany), but before that you probably have to withdraw your AOS application. Withdrawal is better than just abandon and get it finally denied.
 
Abandoning GC

Thanks for the replies everyone.

I have absolutely no problem in proceeding ahead with abandoning the GC process. I dont really have a need for it now and I cannot compromise my career waiting for the INS.

Anyways, keeping all that aside, what are the steps to abandoning the GC ? Whom should I contact ? How long the process takes ?

Any clues on that ? Any web site with links on that?
