I am from a mid east country but not on the T7 list. I wasn't subject to special registration the last time I entered the US in 2005.
I have a visa from a previous employer(valid until 04/2007), my old I94 was valid until 04/2007 also(the same date on my visa).
When I changed jobs, I ported to my current employer, I also applied for an extension and got it approved to 04/2009.
My newest I797 approval was a 3rd 3 year (extension), I had two visas from previous employers ang got the 3rd I797 with extension because I have an approved I140 from my previous employer.
My canadian immigration has finally gone through after over 2 years.
I need to land in canada before applying for AP. I want to go within the next two weeks and come back in a couple of days.
I don't want to lose my current I94 (valid until 04/2009) - can I use the AVR (30 day) rule EVEN WITH MY VALID VISA AND NEW EXTENDED I94??
What I don't want to happen is to go and come back on a new I94 that only gives me a valid stay until 04/2007 like my visa.
My wife will be accompanying me on this trip, she last entered the country after I had changed jobs but before I got my approval so she only got an I94 valid until 04/2007 like her current H4 visa. I am hoping to get them to give her a new I94 valid until 04/2009 based on my approved I797 and current I94. Do you think this is possible?
I also need to find the specific ISCIS rule that states that the I94 authorized stay should be given based upon the approved petition and not the validity of the visa.
