I travelled outside of US for two weeks and just came back by using my AP recently. The Immigration officer stamp 05/29/03 on my I94 card, which my current AP valid until this date. I have tow questions.

1. Does this mean that I only can legally stay in US by this date(05/29/2003)?
2. What can I do to make me legally stay here until I get my green card?

thanks,

your stay after that date is legal since ur 485 is pending . Normally the officer should hv given u a 1 yr stamp from the date of arrival according to latest rules. but its okie t stay after that also.

AP

Looks like this is general practice by officers, I entered using AP on 11/29 & got I-94 stamed valid till Jan 6 2003 which is my AP expiration date.Less then 2 months.

May be we should carry a rulebook in hand to show them it needs to be stamped for 1 yr. There was a thread on this forum once on this rule. I definately will carry some printouts now.
thanks u guys .

Using AP to travel with H1-B expired.

Hi Greentea/Everyone,

* Greentea... Was your H1-B still valid when you left
the country? Did you leave the country past your
I-94 'valid until' date on ur passport?
----
* Mine expired in august 2002. My current status is AOS
pending for > 365 days.

* So my question is, if I were to travel outside the US now,
since my H1-B has expired and my I-94 was stamped only
till august 2002, is there going to be a problem?

* Can the emigration people say that I overstayed? Or
the emigration does not care if the date of leaving the country
is past the I-94 date? Are there any repercussions when I
return back?

* Since I just applied for AP+EAD extenstion and my AP is valid
only until Dec 09, 2002 is it possible for me to get some kind
of emergency AP in San Jose? I may need to make a trip to
India in a hurry if I am needed in case of a family emergency.

Please do advise. I live in Santa Clara.

Thanks,
Rajesh.
