Hello,
I have a complicated situation and would sincerely appreciate your
legal and practical guidance. It's not a sham, it's just how life
works out.
1. Lady A. (with a 10 yr old son, ex-husband/father not involved) in
Viet Nam was engaged and sponsored by fiance Gent B. (permanent
resident) living in California to file for visa to enter the US for
marriage.
2. During the engagement/sponsor paperwork, things were not working
out between the 2 and decided to go seperate ways, but they let the
petition paperwork continue its course.
3. Lady A. and Gent C. (naturalized citizen, living in Texas,
definitely qualified to sponsor similar petition) meet in VN and fall
in love in the meantime.
4. US Consulate recently invites Lady A. to bring her passport so it
can issue visa to enter US (for marriage with Gent B.)
So... what should Lady A. and Gent C. do now, they would very much
like to marry one another and live in the US.
5. If Lady A. comes to US and not marry Gent B., she would have to go
back in 90 days. That's OK, we're in for the happy and long term
relationship. But will the second petition be taken seriously or will
she have a tough time with interview etc and practically have no chance?
6. Can we (A. & C.) get marry while she's here in the US and have some
chance with INS for her to stay? Or will they assume the worst case
and deny stay?
7. What would be the best things we can do to live with one another
the soonest?
8. Would ignoring the current petition/visa and filing for work or
some other visa be a wise idea? Or should we start from scratch with
2nd fiance petition?
