Employment RFE - Help

I received the following RFE’s from BCIS, dated 22-08-2003

EMPLOYMENT

“The record contains a letter from your prospective employer. The letter indicates that you have been employed at XYZ as a Programmer Analyst. However the record does not contain any evidence which establishes that the terms of the permanent employment petition continue to exist. Therefore, you must submit a currently issued letter or other evidence from the prospective permanent employer indicating that the terms and conditions of the employment petition continue to exist.”

Is this a standard employment RFE?

Mine is AC-21 Case, I got laid off from XYZ after 180 days of I-485 submission. Should invoking an AC-21 letter and an employment letter from Current Company take care of this?

The other RFE (combined) was asking for affidavits for Birth Certificate.

Any thoughts?
 
If I were you...

I would get an attorney to file the AC-21 papers and get the exact wording of the employment letter from your new employer. This is a critical juncture after a long wait and you would like to see that nothing goes wrong now.

Don't worry

It seems that your employment letter missed an important line - thats all. No need to worry. Just get an updated letter that includes line like "this job is permanent" or variations of that sentance like "Mr. XXX will be employed in a full-time permanent position" or " Mr. XXX will be employed indefinately" or something like that.

Consult with your lawyer.
