Employment Letter

Hi Guys,

It is now more than 1 year of my I-485 application (RD in first week of August 2001). Obviously the employment letter and pay stubs that I submitted with my application (dated in July) are also more than 1 year old. Do you guys think this would generate RFE?

I would doubt it

RFE's can be generated for mutiple reasons - employment verification, medical, validity of H1 (I think so!).

The reason I say validity of H1 is because if one is working on EAD and the H1 is no longer valid or quite close to its expiration date and no extn was applied, then prob. INS wants to verify if one is working - meaning, has a stable job - so with an employment letter + pay stubs that gets proven. Sometimes they want to see tax returns, etc.

My RD was Aug 23 '01 and I got my approval on Aug 02 - there was no RFE.
