For 485, you need an employment letter. Suppose the applicant is working for the sponsoring employer. Should the employment letter say what the current salary and job is OR should it state that the job on which visa petition is approved will be available to me when GC is approved and what salary will be paid then?

I have seen lot of RFEs on employment letter and paystubs, so would like to know what should the letter say to avoid RFE.

Thanks.

I have seen that letter. But, the way it is written it seems like it is for someone who is not working for the sponsoring employer while his/her GC is in process. I am employed by the company who is doing my GC, what should the contents be for that scenario.

Thanks

Hi Abhi:

I recently had the same qts for the user of this forum, when I was issued a RFE this is what my lawyer gave me in short.
You need a letter from your current employer, stating you are currently employed for the company and they plan to keep you past your I-485 Approval and your current salary (does not have to be the same as stated in your Labor Certification approval) In my case I was making less than what was stated in the labor Certification, but acc to my lawyer that salary is what I would be making after I get my GC, did not make sense to me. But you also need to state your job duties and that should be similiar to waht was stated in the Labor Certification and so on and so forth.
I guess the INS is intersted in verfying you are currently employed and what you are making and your job duties.

I hope that helps, I was also asked to provide last three months pay stubs and 2 years of tax returns.

Take care and hang on you are there,

Ray...
