As required in the AOS interview letter, I and my USC spouse has to take letter from our employer confirming the employment. Is it required that the letter from the employer should be addressed to the BCIS? OR Just “To Whom It May Concern:” on the top of the letter is good enough?

ALSO,

Does anybody who attended AOS (Based on USC/GC spouse), took affidavits from friends or somebody (as required while removing condition, in case of conditional GC) mentioning that marriage is in good faith?

Thank you for your replies.

Normally a copy of the recent paystub (or 1099 i think, if self-employed) is enough to prove employment. I have read of cases where proof of employment was not included with the I-864 application and the interview letter asked the sponsor to get proof of employment to the interview. If they have specifically asked for a letter from employer, then you should get one. The format doesnt matter. Employers have a standard format.

For the AOS interview, i dont think it is needed to get affiavit from friends/relatives that the marriage is bonafide. The main criteria is financial support and joint responsibilities. This is my opinion, others who have attended the interview pls clarify.

You are right that I-864 doesn't require the employment letter. However, my interview letter clearly mentions following " If you are employed bring a Letter from each employer on company stationary, verifying current rate of pay and average weekly hours, and paystubs of past 2 months;"

Well, you answered yourself. The best advice always is to follow what they are asking you PLUS something more even could sounds silly. In this case then, ask your employer for a work letter with all that information plus your paystubs. What they want is to verify with your employer what your paystubs says, why? USCIS is like that. With some do with others don't, it is just a rollercoster. Hey you are almost finishing!! good luck!!!

Good luck,

From your statement i assume that you did not submit proof of employment with your I-864 and hence the requirement to bring a letter from the employer. In my opinion, it doesnt really matter what format the letter is as long as it is on the company stationary.

(P.S: I hope you know that If you used your income to qualify, then you get a letter from your employer. If income of USC spouse was used, then you get a letter from employer of USC spouse.
