employment -i40 issue

1)Have experience letter's for the min experience mentioned in labor, but don't have exp letter for 5months from one of the employer as I was in bench. would just an appointment letter help or any suggestions pls,.......... ( can’t get affidavit too).
2)Also for the other company that i worked can ex-employee give affidavit stating start date and end date or he is not allowed, as only H.R is allowed?

How critical is this for I-140? is min experience is met

As for as I know,

1. If you have experience letters for the minimum experience mentioned in Labor, you are fine.

2. Your Ex co worker can give the Experience letter in the company letter head. (If he/she is working in different company now, then his current company letter head should be used with his job title)

3. If you file/filed in EB3, then it is not at all an issue. But in EB2 case, if minimum experience is met then no problem.

4. Appoinment letter is also O.K.
