Hi,

I did masters 10 years back. And i have around
1.5 years of gap in employment history.
It was due to layoff after 4 years work after which i tried some education degree which was not completed.

So around 8.5 years of experience is in very good companies.

i want to file for H1B, can i face any problems from INS due to this GAP. Also at the same time
my employer want to file my GC as well so can there be any problem in GC due to this employment GAP.

Thanks,

Bruce

Bruce-

I think you are worried about being out of status, correct? If, as you say, you attended an educational institution, then if you changed status to F-1, you may be able to show that even though you had a gap in employment, you were not out of status. USCIS is not concerned with people who are out of work, for one reason or another, instead they are concerned with people who are out of status.

hi,

its first time h1 filing from abroad. so this one and half year gap can create trouble for case or not and how to handle this.
Will there be questions/issues during H1 and later in GC onboard.
Can i just mention in my resume/cv for this period i have been working in some irrelevant work/education which is not required by this job offer, so i am not providing details in resume. What affect will it have what to do.

Thanks
- Bruce
