Employment Contract Breach

Hello ,

I am a M.S student and I had joined a consultancy few months back who had asked us to get certified in Microsoft technologies, which I did. I did not like their work ethics, for e.g. asking me to put 4-5 years of fake experience and projects on my resume etc. Also they never paid me when I was getting myself certified. I had signed a contract for 2 years when I had first joined the company. I left the company recently and they are now threatening to sue me for the damages and breaching the employment contract.
I would be really grateful if someone would suggest me what I can do about the situation.

Realistically, you have 3 choices:

1. Do nothing and see what happens;

2. Retain an attorney to negotiate a settlement with them; or

3. retain an attorney and threaten litigation.

Actually, you could do 2 or 3 above without an attorney but I do not recomment it.

Need advice on the following. - I resigned from my previous employer giving him 2 weeks notice after working for him for 15 months and my last relocation was 8 months back. He has claimed $5000 as liquidation damages saying my contract said at least 1 month of notice is required. I have less than 1 week to send him the amount. The employment contract says
1. I need to give 1 month of notice
2. I need to give 1 month of notice if I resign before 12 months of joining the company
3. I need to give 1 month of notice if I resign within 6 months of any relocation
