I searched the forum to try to answer my question, but I could not find anything. I am on my 4th year of H1B, with 2 more to go. In July 2006, I had my I140 approved, and am waiting for priority date to become current for 3rd preference employment based green card application. The company is going through significant changes and I am considering looking into starting all over and applying for 2nd preference (with another company in the same JV or a different company).
My question is: has anyone done that and if so, what was your experience? Would this revoke my 3rd preference empl based application? Is this risky?
