Employment Authorization Card

Hello,

I was wondering if anybody can help me with my problem. I have an employment authorization card. My card had just expired recently. I don't know whether if my card can get renewed or not. If it can get renewed can somebody please tell me how to renew it. Also, if my card expired, am i still legal in U.S.A. Please reply as soon as possible if you can! Thank You!

It can be renewed, till they make a decision on ur I485. What you can do is, get the I765 renewal form...along with a chk for $120 and 2 photos mail it to the Vermont center...you can get in few weeks..or you can take all the papers to your local INS office they may renew...Many of the people are doing same thing...We also did same thing...went to local INS office n filed our renewal..it took 8 weeks for us...
anyway...contact ur attorney...
 
If your EAD card has expired you cannot work legally in this country provided that you've been using EAD for employment earlier as opposed to H1B. As regards your question regarding your status: it has nothing to do with EAD card. You are legal to remain in this country so long as a decision to I-485 is still pending. If you are using H1B then you are legal as long as you have valid H1 papers AND your I-94 card has not expired.

Thank You for replying back. I still am confused about some things. First of all, what forms would I need to show to the INS office for the renewal of my card. Second of all, where can I find information as to how long they are going to pend my case, so I can find out if I'm okay to live in this country. Thank You very much.
 
You can get the form from this site:

You will also need to send them $120 application fee

Copy of yr 485 receipt

No one can tell u how long yr 485 will be pending but u can legally STAY in this country till a final decision is made.
However u can work legally on yr H1b or EAD. If you do not have a H1b and yr EAD has expired you are not allowed to work.
If your H1b is still valid you can continue to work on it as long as it is valid. You will also need Advance Parole to re-enter US once your H1b expires.

You will need the EAC number which can be found on yr 485 receipt. For EAD renewal u can use the same site but will have to wait for a receipt to get the EAC number. Hope this Helps!
